What is Bail?

Bail, guaranteed by the 8th Amendment of the U.S. Constitution, insures the Court that a criminal defendant will appear for trial.

What does a bail Agent/Producer do?

A bail bond is a surety bond, a guarantee to the court that a defendant who has been released on a bail bond prior to trial appears in court. If the defendant fails to appear, the surety bail agency is responsible, and required, to pay the full amount of the bail bond as a civil penalty for failing to fulfill his obligation. Defendants released on a bail bond must appear in the proper court, at the proper time, each and every time they are called upon to do so until the case has concluded and the defendant has been sentenced or the charges dismissed. If the defendant does not appear, it’s the surety bail agency’s responsibility to either return the defendant to custody or, as a penalty, pay the forfeiture of the bond to the court. That is why a bail bond is also known as an appearance bond. The surety bail agency and the insurance company they represent guarantee the appearance of the defendant as ordered by the court. The commercial bail system is the best form of insuring that a criminal defendant is returned to court, thus insuring the victims of crime their right to justice.

Getting Started

The first step is for you, the prospective bail Agent/Producer, to take an examination and evaluation of market conditions for bail in your area. You might talk to the Police officers and Sheriff’s deputies you know and see what they think your potential for success will be for you writing bail in your area. A solid working relationship with local law enforcement is strongly recommended. Building an honest, respectful relationship with law enforcement, prosecuting attorneys and judges is crucial. After all, the surety bail Agent/Producer plays an important role in the criminal justice system. A question you need to answer is how many people go to jail, and of those, how many actually post bail bonds as opposed to being released on their own recognizance or some other court program

There are four states that do not have commercial bail; they are Illinois, Kentucky, Oregon and Wisconsin. And there are other places where they have very little commercial bail, such as Maine, Massachusetts, and Nebraska.

How to become licensed:

In Michigan, and most other states, surety bail Agents/Producers are licensed by the Department of Insurance. There is not always a specific license for surety bail Agents/Producers. In Michigan, the license required to write bail will be a limited lines property & casualty insurance license. However, most states require a specific Bail Agent/Producer license.

You will need to know the licensing standards and education requirements in your state. Many states prohibit felons from being licensed as surety bail Agents/Producers. Budget Bail Bond Agency will provide you with instructions on how to obtain a license in your state and, when appropriate, provide you with Department of Insurance forms you need to apply, as well as help you with any other requirements such as locating study materials or pre-licensing classes, fingerprints, background checks, personal references, photographs, etc.
